Is giving advice to someone, can held liable for the offence even through you tried to help the victim?

  • My friend and I own a small tapri. We have people of our age coming there. One day there were few boys who came there. They were very rich and were teasing my friend. My friend was very furious. He felt insulted. He came and told me the entire thing. In order to ease his mood, I tried to joke and said that poison that guy. My friend did the same and the guy died. I rushed and took that boy to the hospital and made my friend realize that he has done a wrong act. Am I liable and even if I am would this work as mitigating factors?

What if wife had killed her husband mistakenly ?

My friend’s husband used to come home drunk and beat her brutally. She always feared to complain and thought he would improve someday. One day she came to know that he is cheating on her. When he came home she asked him about the woman. He started abusing her and beating her. In the heat of the moment she threw a show piece at him who hit his head and he died. She was held liable for killing him. It’s very hard to understand the mental state she was going through. Would these work as mitigating factors?

If minor is involved in a murder case with others, will he be liable equally as others criminals?

My son was threatened that if he didn’t help his seniors to leak the question paper they would torture him the entire year. He agreed to help them. While breaking in the staff room, the peon saw them and tried to stop them. Scared, one of his seniors hit the peon on his head. The peon died. Suddenly two teachers came and caught everyone. All of them are now under the trail of cheating and killing the peon. My son is a minor and he has never done such an act before. He was no where responsible for killing the peon. Would these work as mitigating factors?

What if there is mistake from the deceased person in the incident ?

  • I was standing near a square. Two cars dashed in front of me. The driver of one of the cars died. The other person was taken into custody. I was a witness of the entire incident. Although the person who survived was driving fast but I assure that the other person broke the signal and hence the unfortunate incident happened. There are CCTV cameras in the place. Would these work as the mitigating factors and reduce his punishment?

What if someone has given a bag to me and ask to deliver to some person, but later you found that it explodes.

I was in the metro station waiting for my train. A man came and gave me a bag asking if I could give it to his friend who was going to come. His friend is a police inspector. I agreed and gave it to a police inspector who came near to my place saying that his friend dropped it here. After giving it to him, I went straight to board my train. There was an explosion and the police inspector died. A man sitting there saw everything and blamed me. I was scared and started running. A police inspector came running behind me and caught me. I was caught for abetting his murder. How can I prove that I am not liable?

What if someone who hadn't got caught in past but get caught after 10 years of the offence?

  • My husband used to do petty offences and had associations with wrong people. One day all of them murdered a very rich person of the city. They were not caught. Our son was killed by his competent and we couldn’t file the case against him as we were always in fear of being caught. My husband gave up all the bad work and opened a charitable trust under our son’s name. It’s been 10 years and my husband didn’t look back. Our trust has provided scholarships to thousands of children; we provide shelter to abandoned children and currently run 10 Ngo’s. We take out a very meager amount from his earnings and the rest is used for the trust. One day the police found out about the murder and threw my husband behind the bars. I know his act was wrong but now he is nothing of what he was in the past. Would these work as the mitigating factors?

What if any prank resulted to suicide of any person. Will he/she be punished for abetting her to commit suicide?

  • There are 7 girls in my group. We all hate a girl in our class. She has always troubled one of us. One day one of my friends decided that we will take revenge. All of us wrote a love letter to our math teacher with her name and attached it to her answer sheet. When I reached home I felt sad and decided that this was wrong. I tried to call her but her number was switched off. Next day I even tried to speak to that girl but as we were on bad terms she didn’t listen to me. I tried to talk to our math teacher but he was very mad at her and even he didn’t listen. Soon the whole school knew about it. Our principal shouted at her and her parents were called. She wasn’t able to bear that embarrassment. One day we came to know that she drank poison and died. I wasn’t able to bear the guilt and hence I confessed what actually happened. All my friends are now blamed for abetting her to commit suicide. I was wrong to some extent but I tried my best. Would all these work as mitigating factors? Would I be punished for abetting her to commit suicide?

What if I have killed someone in condition where I need urgent money?

  • My husband lost his job. We were going through a bad time and all our relatives washed their hands off us. One day I was detected with third stage cancer. All our insurances had expired. One day the doctor demanded 20 lakhs for my first chemotherapy. My husband assured that he will try to get the money as soon as possible. After two days he came up with 20 lakhs. I asked him how he managed to get such a big amount. He said that he had some of his savings. That day in the evening the police came to our house and said that my husband has committed murder and arrested him. Later my husband told me that there was a woman in his office who was tortured by her husband and told my husband that if he poisons her husband she would give him the money. My husband went a night before to the lady’s house and peeped through the window of her hall and saw that her husband was beating her. The lady has worked with him for 10 years and he assures that the lady didn’t cook up anything. The doctor has said that I have very few days. I want to spend those few days with my husband. He said one day that he would start a new job and save as much as he could and open a trust for cancer patients. I agree that my husband has done a wrong act but he is not a murderer and he does not deserve to be punished the same way. I have heard about mitigating factors in law. How could it help me?

What if anyone is trying to help but then too that person died?

My husband and my son went for fishing. My husband was with his friend who came along with his son. Both the boys were 8 year olds. My husband and his friend were lying along with the boys when they dozed off. The boys took a small boat and went to the river. My husband suddenly woke up and saw that both the boys weren’t there. He went around looking for them when he saw that both of them were drowning. He went running and dived in the river. Both the boys were drowning in the opposite directions. He first went to save our child. He carried our boy to the shore and helped him to push the water out. Our boy recovered. He then went to save the other child. When he bought him to the shore the child wasn’t breathing. He tried whatever was possible. He woke his friend up and rushed him to the hospital. The child died. His friend sued him. It was a very critical condition and anyone would be partial in this aspect. He tried the best he could to save his friend’s child. We are really sad. We expect that my husband will have to go to prison shortly. I have no clue about law but I have heard that there are mitigating factors which reduce the punishment. I hope that law provides justice to us? How would law protect my husband in this aspect?

What if shop refused to return the security money?

  • I was traveling with my college friends on vacation. We booked a self-driving car for 3 days. The car rental shop asked us to deposit a sum of money as a security deposit. They ensured us that the security deposit is completely refundable. After 3 days, when we returned back the car, the car rental shop refused to refund our money.

Does National Consumer Dispute Redresal Commission have jurisdiction over the description cases?

I bought a house from TY Builders and Corporation. The house did not match the description of the house in the contract. I wish to claim damages on the ground of inefficient services. Does National Consumer Dispute Redressal Commission have the jurisdiction to address my dispute and provide redressal to me?

What if showroom is not taking it's responsibilty towards customer?

  • I bought an imported watch from a showroom in my city. But now the showroom has shut down. I've emailed the customer care people that are saying that I need to go to Paris to claim that warranty? Is that so? because the watch is really expensive. Please help me with what should be the course of action.

What remedies can you get if builder is trying to cheat you?

  • I purchased a flat in Mumbai. The builder promised give me the possession in the same on 1st January 2015 with the facilities of 3 tier security facility inclusive of CCTV in the building, Club facility in the society, 24 hour supply of clean water etc. He gave me the possession on time but without any facilities which was promised by the builder. I have made repetitive reminders through telephone as well as I have written many letters to him. But he has still not done anything. But legal remedies are available to me.

Can we sue company if they are not selling their product according to the label mention?

I went to the mall yesterday to buy some sheets for the bedroom, I’m extremely allergic to certain synthetic fibers and so buy only 100% cotton sheets, I bought two sheets at a very expensive price. the label said it was pure Egyptian Cotton. I got home and washed the sheets as is my habit and put them on the bed. The next morning when I woke up I had a huge rash on the whole side of my face. I knew it was the sheets as this type of rash has happened to me before. I only bought the sheets as they clearly said Pure Cotton. When the label said pure cotton isn’t it implied that the product is as advertised?

What if service-man is trying to do fraud with customer?

  • I bought a water purifier a couple of years ago. It came with a 2 year warranty and there after I renewed the service contract diligently every year. The warranty covers small parts and the filter which is to be regularly changed as per the terms of service. Yesterday when the serviceman came home he finished the service and handed me a bill for the filters. When I told him that they are covered under the warranty, he said that it was covered only under the original warranty that came with the product and not the renewable service contract. I told him that I had already been serviced once this year before and that the filters had been changed under the new contract to which he said that it must have been an error on their part. I didn’t have a copy of the contract on hand and he had already changed the filters so I could hardly ask him to remove them, I didn’t want to not pay the poor man as then the cost would be cut out of his salary. I eventually found the renewed contract and saw that the filters were included and so I called the service no and they said that I should not have paid the money and that now there was nothing they could do about it. How do I get a refund, who do I claim against?

What if any company is misleading customer about it's product by giving ad in newspaper?

Yesterday there was an ad in the newspaper for the sale of a fridge & microwave combo. The ad said the offer was valid for a week. When I got to the store on the afternoon of the first day of the offer I was informed that they were out of stock and that they had plenty of other products I could choose from, which were a lot more expensive I might add. They never intended to give that offer to people; it was just a way to sell more items. I wish to claim the offer they advertised, what do I do?

What if any company is misguiding about it's product to the customer?

I’m opening a rooftop lounge in a prime area of Mumbai. Last month I placed an order for 10,000 sq.ft of blue mosaic tiles for the flooring. The tiles are important for the look I’m trying to achieve, when I placed the order I was assured that the store had stock and that it would be delivered in a week. I still placed an order ten days prior and paid the entire amount, when the week was up and the tiles weren’t delivered I called the store and they said that due to some transportation problem there was a delay and that they would be delivered in two days at most. It was two days later and still no tiles in sight. My entire project was on a standstill, when I said as much the store said that maybe I should choose another tile. The lounge is on a rental property and every day’s delay costs me. What is more is that I have already paid a substantial amount for those tiles. The store eventually told me that they did not have enough tiles in stock for my order when I placed it and that they were trying to source more. I was misled into placing the order, they knew they couldn’t fulfill the order and so I suffered a great loss because of the same. How do I claim damages?
