I’m opening a rooftop lounge in a prime area of Mumbai. Last month I placed an order for 10,000 sq.ft of blue mosaic tiles for the flooring. The tiles are important for the look I’m trying to achieve, when I placed the order I was assured that the store had stock and that it would be delivered in a week. I still placed an order ten days prior and paid the entire amount, when the week was up and the tiles weren’t delivered I called the store and they said that due to some transportation problem there was a delay and that they would be delivered in two days at most. It was two days later and still no tiles in sight. My entire project was on a standstill, when I said as much the store said that maybe I should choose another tile. The lounge is on a rental property and every day’s delay costs me. What is more is that I have already paid a substantial amount for those tiles. The store eventually told me that they did not have enough tiles in stock for my order when I placed it and that they were trying to source more. I was misled into placing the order, they knew they couldn’t fulfill the order and so I suffered a great loss because of the same. How do I claim damages?
