Terms and Conditions

Our Terms and Conditions(“Terms”) governs the relationship between Quaeritur Legal Private Limited (“We”, “Us”, “Our”, “The Company”, “The Website”) and Users (“You”, “Yours”) of this website our users of all kind unless and until there is separate agreement between us and our user. By using our services you agree to be bound by the Terms and understand the nature of the service (mentioned below) which is being provided by us.

  1. Definitions:

    1. “Lawyers”

    2. “Information” means any content posted on the website by the users, or any data/content provided by the users while registration on the website.

    3. “Primary Source” mean primary source of information such as government website, official gazette, bare acts of legislations, government notifications etc.

    4. “Act” means Advocates Act, 1961

    5. “Rules” means Bar Council of India Rules

    6. “BCI” Means Bar Council of India

    7. “SBC” means relevant State Bar Council

    8. “Bar Council Means” relevant Bar Council.

    9. “Website” means www.beforethecourt.com

    10. “User” means any person registered as a professional or any person availing services on the website.

    11. “BeforetheCourt” represents both the website and the company Quaeritur Legal Private Limited.

    12. Legal Professionals means any person who is entitled by law to practice law.

  1. BeforetheCourt is an internet portal that facilitates discussion between legal professionals and potential users of legal services. Beforethecourt acts as a portal for the potential users to raise questions/issues and for the Legal Professionals to discuss the issue in a public forum. BeforetheCourt does not guarantee that users will successfully find an advocate/lawyer/attorney through this system. BeforetheCourt takes no position and offers no opinion on when or if a lawyer-client relationship has been formed. In order to provide an optimal forum for lawyers and clients, BeforetheCourt does not involve itself in the agreements between lawyers and clients or the actual representation of clients.

  1. No Legal Advice- The information generated on the platform in the course of a discussion between the Legal Professionals and the potential users shall not, in any way, be considered as a Legal Advice. BeforetheCourt does not represent the authenticity or warranty of any information generated in course of the discussion. All the information on the website is a result of intellectual and informational discussion and should not be taken as a legal advice.

  1. Registration- Certain sections of BeforetheCourt may require you to register. If registration is requested, you agree to provide BeforetheCourt with accurate and complete registration information. It is your responsibility to inform BeforetheCourt of any changes to that information. Each registration is for a single person only, unless specifically designated otherwise on the registration page. BeforetheCourt does not permit

    1. any other person using the registered sections under your name; or

    2. access through a single name being made available to multiple users on a network.

You are responsible for preventing such unauthorized use. If you believe there has been unauthorized use, please notify BeforetheCourt immediately by contacting us. If we find that unauthorized use is being made of BeforetheCourt and the services we provide, the right of any or many users may be terminated.

  1. Not Agency Function- BeforetheCourt is not an agent of any particular lawyer. It only facilitates the communication of Legal Professionals and potential users. Any electronic communication sent to BeforetheCourt alone will not create a lawyer-client relationship between the user and BeforetheCourt, such being expressly denied.

  1. Nature and accuracy of the Information:

    1. You agree to provide true Information to the best of your knowledge and warrant any Information provided by you is accurate and true to the best of your knowledge.

    2. You understand that the Users on the website have varied level of knowledge and and you do not take the information provided by them to be true or update.

    3. You agree to crosscheck information from any of the Primary Source of the information before relying on any Information found on this website.

    4. You understand that The Company is not responsible for inaccuracy of any information provided by any User.

    5. The accuracy of legal Information changes from time to time with changes in law and government policies. The Information produced and given on this website is subject to such changes.

  1. Solicitation: Solicitation of Lawyers is prohibited by Bar Council of India(Chapter 2, Section 4 of Bar Council Of India Rules. We do not promote solicitation of lawyers and respect the Rules and the Act. By using this website you agree and understand that:

    1. If you are a lawyer: You shall not solicit yourself or your work in any way on the website which shall violate the Bar Council of India Rules.

    2. If you are a lawyer or any other user: You understand that the rating and recommendation system is based on reviews of the Users and other factors, none of which indicates quality of a lawyer or promotes a lawyer. The rating only indicates the quality of the User on the website based on other users ratings, activity of the website and authenticity of the User.

    3. We may charge some users to provide them premium features on the website.

    4. We do not promote any user or professional, the rating of the users are standardized on the following grounds-

      1. Verification of profile details

      2. Score given by the users who have converted into client of the lawyer

      3. Points earned by activities on the website including but not limited to answering, asking question, upvoting, downvoting, receiving upvotes and downvotes.

  1. No Attorney Client Privilege: Any public discussion on the Website is not governed by attorney-client privilege as there exists no attorney-client relationship and the discussion is being done in public domain.Any discussion done through private message may be governed by the attorney-client privilege if there exists an attorney-client relationship.

  1. Our Proprietary Rights- All right, title, and interest in and to the Service (excluding Content provided by users) are and will remain the exclusive property of BeforetheCourt and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Except as expressly provided herein, nothing in the Terms gives you a right to use the BeforetheCourt name or any of the BeforetheCourt trademarks, logos, domain names, and other distinctive brand features. Any feedback, comments, or suggestions you may provide regarding the Service is entirely voluntary and we will be free to use such feedback, comments or suggestions as we see fit and without any obligation to you.

The Service may include advertisements, which may be targeted to the Content or information on the Service, queries made through the Service, or other information. The types and extent of advertising by BeforetheCourt on the Service are subject to change. In consideration for BeforetheCourt granting you access to and use of the Service, you agree that BeforetheCourt and its third party providers and partners may place such advertising on the Service or in connection with the display of Content or information from the Service whether submitted by you or others.

  1. Disclosure of information during unlawful activity- BeforetheCourt reserves the right to investigate complaints or reported violations of the Agreement and to take any action BeforetheCourt deems appropriate including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to user profiles, e-mail addresses, usage history, posted materials, IP addresses and traffic information.

  2. Confidentiality: Confidentiality of Information given by You or any User depends on the nature of the Information and shall be subject to our privacy policy.

  1. Indemnity- Your access to and use of the Service or any Content is at your own risk. You understand and agree that the Service is provided to you on an "AS IS" and "AS AVAILABLE" basis. Without limiting the foregoing, BEFORETHECOURT AND ITS PARTNERS DISCLAIM ANY WARRANTIES, EXPRESS OR IMPLIED, OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We make no warranty and disclaim all responsibility and liability for the completeness, accuracy, availability, timeliness, security or reliability of the Service or any content thereon. BeforetheCourt will not be responsible or liable for any harm to your computer system, loss of data, or other harm that results from your access to or use of the Service, or any Content. You also agree that BeforetheCourt has no responsibility or liability for the deletion of, or the failure to store or to transmit, any Content and other communications maintained by the Service. We make no warranty that the Service will meet your requirements or be available on an uninterrupted, secure, or error-free basis. No advice or information, whether oral or written, obtained from BeforetheCourt or through the Service, will create any warranty not expressly made herein.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BEFORETHECOURT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS AND LICENSORS WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOOD-WILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (i) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (ii) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (iii) ANY CONTENT OBTAINED FROM THE SERVICE; AND (iv) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, WHETHER OR NOT BEFORETHECOURT HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

If anyone brings a claim against us related to your actions or Content on the Service, or actions or Content by or from someone using your account, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

  1. Advertisers- BeforetheCourt may contain advertising and sponsorship. Advertisers and sponsors are responsible for ensuring that material submitted for inclusion on BeforetheCourt is accurate and complies with applicable laws. BeforetheCourt will not be responsible for the illegality of or any error or inaccuracy in advertisers' or sponsors' materials.

  1. Linking to Beforethecourt.com- Users are welcome to provide links to the homepage of BeforetheCourt, provided they do not remove or obscure, by framing or otherwise, any portion of the homepage and that you discontinue providing links to the site if requested by BeforetheCourt.

  1. Severability of the contract- The Agreement and the Privacy Policy constitute the entire agreement with respect to the use of the service provided by BeforetheCourt. If any provision of these terms and conditions is unlawful, void or unenforceable then that provision shall be deemed severable from the remaining provisions and shall not affect their validity and enforceability.

  1. Modification to terms of use and modification to services- BeforetheCourt may change the agreement at any time. The user will be responsible for checking the Terms and Conditions before use. Use of the service after the change will indicate acceptance of the new terms and conditions.

Further, BeforetheCourt reserves the right to modify or discontinue, temporarily or permanently, the service with or without notice to the user. The user agrees that BeforetheCourt shall not be liable to the user or any third party for any modification or discontinuance of the service. The user acknowledges and agrees that any termination of service under any provision of this agreement may be effected without prior notice, and acknowledges and agrees that BeforetheCourt may immediately delete data and files in the user's account and bar any further access to such files or the Service.

  1. Dispute Resolution-

  1.  This Agreement is in the English Language and no translation into any other language shall be a valid interpretation.

  2.  This Agreement is governed by and shall be construed in accordance with the existing Indian Laws.

  3.  In the event any Party is in breach of any of the terms of this Agreement, another party may serve a written notice to Party in breach to cure such breach within thirty days of the receipt of such written notice thereof.

  4.  In the case of any dispute or claim arising out of or in connection with or relating to this Agreement, or the breach (where such breach has not been cured by the Party in breach within thirty days of written notice thereof), termination or invalidity hereof, the Parties shall attempt to first resolve such dispute or claim amicably.

  5. If the dispute is not resolved through such discussions within thirty days after one Party has served a written notice on the other Party requesting commencement of discussions, such dispute or claim shall be finally settled by negotiation or arbitration under the Arbitration and Conciliation Act, 1996, by an arbitral tribunal comprising three member.

  6. Such arbitration shall be in accordance with the rules of the International Chamber of Commerce and shall be held in New Delhi.

  7. All arbitration proceedings shall be conducted in the English language and place of arbitration shall be New Delhi. The Parties shall be entitled to seek interim relief from the courts of India.

  8. The cost and expenses of the arbitration, including the fees of the arbitrators shall be borne equally by each Parties of the dispute. Each Party shall pay its own fees and other charges of its counsel. The arbitral tribunal would have the power to award interest on any sum awarded pursuant to the arbitration proceedings and such sum would carry interest, if awarded, until the actual payments of such amounts
